- The Intellectual Property disclosure will inform users that the contents, logo and other visual media you created is your property and is protected by copyright laws.
- A Termination clause will inform that users’ accounts on your website and mobile app or users’ access to your website and mobile (if users can’t have an account with you) can be terminated in case of abuses or at your sole discretion.
- A Governing Law will inform users which laws govern the agreement. This should the country in which your company is headquartered or the country from which you operate your web site and mobile app.
- A Links To Other Web Sites clause will inform users that you are not responsible for any third party web sites that you link to. This kind of clause will generally inform users that they are responsible for reading and agreeing (or disagreeing) with the Terms and Conditions or Privacy Policies of these third parties.
- If your website or mobile apps allows users to create content and make that content public to other users, a Content section will inform users that they own the rights to the content they have created.
The “Content” clause usually mentions that users must give you (the website or mobile app developer) a license so that you can share this content on your website/mobile app and to make it available to other users.
Because the content created by users is public to other users, a DMCA notice clause (or Copyright Infringement ) section is helpful to inform users and copyright authors that, if any content is found to be a copyright infringement, you will respond to any DMCA take down notices received and you will take down the content. - A Limit What Users Can Do clause can inform users that by agreeing to use your service, they’re also agreeing to not do certain things. This can be part of a very long and thorough list in your Terms and Conditions agreements so as to encompass the most amount of negative uses.
J.C. Fence CO. offers a three-year limited warranty on workmanship. The fence will be installed correctly according to manufacturers, industry and regional standards. If you should have any questions or concerns about your installation, please call our office at 978-681-0021 and we will send qualified personnel to evaluate and ensure standards are maintained before finishing the installation. The warranty does not cover abuse, accidents or acts of God. This warranty does not cover wood fencing against warping, shrinking, decay, loose knots, checking, cracking, mold, etc. Wood is a natural forest product and is subject to all the above-mentioned characteristics of harvested lumber. Please ask your Project Manager for more information on wood fencing or any deeper explanations of circumstances not covered. Gates are not covered under the limited warranty. Gates are live, swinging loads that pivot on an axis. Misuse and accidents cause many issues with the hinges, latches, gates and gate poles. Especially in high winds with vinyl but also with all gates, pressure can cause gates to become unlatched, swinging and breaking them. Lastly, due to the weather in our area of the country, even when installed below the frost line, gate poles are subject to lifting, sinking and moving from the freezing and thawing of the ground. New England’s severe weather shifts wreak havoc on outdoor gate integrity and is the reason why we cannot warranty the prolonged integrity of the gate as part of our coverage. Locking your gate or using a carabiner hook to secure gate latches can go a very long way in keeping your gate safe and long lasting J.C Fence does not take any responsibility for underground pipes or cables. DigSafe will be contacted to mark any utilities however any sprinkler and/or private lines will not be marked. While digging it is possible these underground obstacles will be hit and damaged. J.C. Fence charges $50.00 per sprinkler repair. If customer chooses to have them repaired themselves, J.C. will leave the hole exposed for Irrigation Company to return and make repairs. Final payment will not be withheld from J.C Fence for any damage to any underground obstacles Please confirm you have reviewed and agree to all disclosures (see bottom of CONTRACT) and all check boxes (left and right side of drawing on the contract). This includes checking all material styles as well as lay out drawings for your project. Please double check gate widths, locations, swing directions in addition to fence heights or any other special details to meet your expectations. Completed agreement is required before any J.C. Fence installation can be confirmed or executed.
